Terms of service

Effective from · Virtuell s.r.o., Company ID 10746170

1. Introduction

These terms govern the use of Stagendo, the web application available at https://app.stagendo.com and the website on which it is offered (the “service”). The service is operated by Virtuell s.r.o., company ID 10746170, VAT ID CZ10746170, registered office F. A. Gerstnera 2151/6, 370 01 České Budějovice, registered in the Commercial Register kept by the Regional Court in České Budějovice, section C, file 30822 (the “operator”). You can reach us at podpora@stagendo.cz.

In these terms:

  • user means anyone who creates an account, is a member of an account or otherwise uses the service,
  • account (also organisation) means the company, office or other customer for which an account is created in the service. The plan, credits, limits and data retention always apply to the whole account,
  • account owner means the user who has the owner role in the account. Only the owner orders and pays for plans and packs and manages the subscription,
  • plan means the version of the service set for the account (Free, Start, Pro, Studio or Office). Every account has exactly one plan,
  • subscription means the contract for a paid plan, which renews automatically for the chosen period (monthly or yearly) until you cancel it,
  • credits are the units used to pay for actions in the service, for example photo edits and videos. Credits are not money or electronic money,
  • pack means a number of credits paid for once: a top-up pack for accounts with a subscription, a one-off pack for accounts without one,
  • inputs are photos, videos and other material a user uploads,
  • outputs are edited photos, videos and other results the service creates from inputs.

The service is intended mainly for businesses such as estate agents, photographers and developers. If you use it as a consumer, article 12 applies to you as well.

2. Registration and account

Registration is free and a new account starts on the Free plan. You provide truthful details, in particular your name and email, and confirm your email address through the link we send you. A new account is named after you and its owner can rename it at any time. Actions that cost credits cannot be started without a confirmed address.

Keep your login details safe. You are responsible for activity under your account unless you show it happened through no fault of yours. Please tell us immediately if you suspect misuse.

The plan and credits belong to the account and are shared by all its users. Projects are only folders for sorting inputs and outputs; no limits or credits are tied to them. The account is responsible for who can access it and how credits are used. Only the account owner manages and pays for subscriptions, purchases and plan changes.

The plan sets how many users an account may have, as shown in the price list in the app. On single-user plans the account can be signed in in only one place at a time: a new sign-in ends the previous session.

Team accounts: on plans that allow it, the account owner invites other users by email invitation and may remove them from the account at any time. An invitation can only be accepted by the person it was emailed to. Each member signs in with their own email and password. Members share the account's plan and credits, but only the account owner pays for and manages the subscription. A member may leave the account at any time. Removal or leaving ends the member's access to that account. Inputs and outputs they created stay in the account. If the account's plan has fewer seats than the account has members, members beyond the seats can only view and download the account's data.

One user may be a member of several accounts, for example their own and a team account, and switches between them in the app. Credits, plans and data are never shared between different accounts.

Only a person aged 18 or over with full legal capacity may create an account.

3. The service

The service lets you edit property photos (for example virtual furnishing, decluttering, renovation previews, exterior, light or perspective edits), create short videos from photos and clips, and manage inputs and outputs in projects. The current range of features is described in the app and may evolve. Which features, resolutions, video lengths and batch sizes are available depends on the account's plan.

Outputs are created by automated tools, including artificial intelligence tools. An output is a visualisation, not a faithful record of a property's actual condition. The same request may lead to different results, and an output may not always match what the user had in mind.

The operator aims for uninterrupted operation but does not guarantee it. The service may be temporarily unavailable because of maintenance, updates or outages at suppliers.

4. Plans and prices

  1. The current plans, their prices, credits, limits (for example number of users, resolution, video, batch size and data retention) and the available packs are listed in the price list on the Subscription page in the app.
  2. The Free plan is for trying the service. The account receives trial credits once, valid for 6 months; downloaded outputs carry a visible label (watermark), and outputs may be used for non-commercial purposes only (article 8). On the Free plan, inputs and outputs are kept for 7 days (article 10).
  3. Paid plans (Start, Pro, Studio and Office) include a monthly credit allowance, a commercial licence to outputs and downloads without a watermark. They differ in features, credits, number of users, resolution, video, batch size and data retention.
  4. A paid plan is paid in advance, monthly or yearly at the yearly price shown in the price list. All prices are in euros (EUR) and include VAT.
  5. The operator may change the plans on offer, their prices and limits. A price change applies to a running subscription no earlier than from the next billing period starting after the change is announced, and we announce it at least 14 days in advance. If you disagree, you may cancel the subscription before then. A change does not affect a period already paid for or credits already purchased.

5. Credits

  1. Actions in the service are paid for with credits. One standard photo edit costs 1 credit; more demanding actions (for example a higher resolution or video) cost more credits. The app shows the exact number of credits before the action starts. The operator may change the number of credits per action. A change does not affect actions already started or credits already purchased.
  2. Credits are reserved when an action starts and charged once the output is created. If an output cannot be created, the reserved credits are returned automatically. If the credits the reservation came from have expired in the meantime, they are returned as new credits valid for the period shown in the app, at least 30 days.
  3. Monthly plan credits are added at the start of each monthly period (yearly subscriptions included) and expire at its end. Unused monthly credits are not carried over to the next period.
  4. Pack credits (top-up and one-off) are valid for 12 months from purchase. Only an account with a subscription whose plan allows top-ups can buy a top-up pack. One-off packs are for accounts without a subscription. An account whose paid plan has ended cannot buy a one-off pack until it pays for a plan again (article 6).
  5. Bonus credits, for example referral rewards or credits the operator adds as a goodwill gesture, are valid for 12 months from being added. Free plan credits are valid for 6 months from being added.
  6. Credits are used from the plan's monthly allowance first, then from other credits (pack, bonus and Free plan credits) in order of the nearest expiry date.
  7. Credits cannot be exchanged for money or transferred to another account. No money is refunded for unused or expired credits. This applies to all types of credits. The only exceptions are set out in articles 12, 15 and 16.
  8. Regenerating an output with the same settings may be free a limited number of times, depending on the plan. To protect the service, the operator may also set a daily limit of actions or a limit of simultaneous jobs per account.

6. Orders, payment and subscription

  1. You order a plan or a pack on the Subscription page in the app. Only the account owner can order and pay. Before every payment the app asks for the confirmation described in article 12; the payment cannot be completed without it. Payment is by card through the Stripe payment gateway. The contract is concluded when the payment is completed. We add the plan and credits to the account as soon as the payment gateway confirms the payment, usually within a few seconds.
  2. A subscription is paid monthly or yearly, renews automatically at the end of each period and the price is charged to the saved card until you cancel. The next renewal date is shown in the app.
  3. Cancellation: you can cancel the subscription at any time in billing management (the customer portal), which you reach from the Subscription page. Cancellation takes effect at the end of the paid period. Until then you keep the plan and its credits; after that the account moves to the Free plan, monthly credits expire and pack and bonus credits remain until they expire. Cancelling a subscription does not refund any part of the price paid.
  4. Plan changes are possible only in the app on the Subscription page; the plan cannot be changed in billing management.
  5. Moving to a higher plan takes effect immediately. You pay a prorated share of the price difference for the rest of the period and we add a prorated share of the difference in monthly credits. Switching from monthly to yearly billing is settled in the same way.
  6. Moving to a lower plan (or from yearly to monthly billing) takes effect from the next period. Until then you keep the current plan and its credits, and the price difference is not refunded. If the lower plan has a shorter data retention period, article 10 applies.
  7. Failed payment: if a renewal payment fails, we mark the subscription as overdue and retry the payment for some time. The plan and credits remain in the meantime. If the payment still fails after repeated attempts, the subscription may end and the account then moves to the Free plan. You can change your card in billing management at any time.
  8. We issue an invoice (tax document) for every payment. You find it in the app and in billing management. You enter your billing details in your profile in the app (you can also add a VAT ID when paying) and are responsible for their accuracy.
  9. Refunds: the operator does not refund payments, including for unused or expired credits, on cancellation of a subscription, on moving to a lower plan or when you stop using the service. Complaints about defective outputs are handled under article 13. Exceptions required by law are set out in articles 12, 15 and 16.
  10. Discount codes: you enter a discount code on the payment page when ordering a plan or a pack. The amount, duration and other conditions of the discount are set by the code. A code cannot be used for a plan change in the app. There is no entitlement to a discount and it cannot be exchanged for money.
  11. After a paid plan ends (by cancellation, failed payment or otherwise) the account moves to the Free plan and no new actions can be started in it: uploading inputs, editing photos or creating videos, for all members of the account including the owner, even if credits remain. You can still view and download inputs and outputs during the grace period under article 10; after that they are deleted under the Free plan's retention period. Work in the account becomes possible again once the owner pays for a paid plan again; buying a credit pack is not enough. Accounts that never had a paid plan are not affected.
  12. Where we sell: for now we sell paid plans and credit packs only to customers established or resident in a member state of the European Union. Before paying you enter your country in the billing details in the app; VAT is charged according to it.

7. Referral programme

An account may invite other accounts with its referral link or code. After the referred account's first payment (a subscription or a pack), bonus credits are added to the referring account and, where the price list or the app says so, also to the referred account. The number of bonus credits and any further conditions are shown in the app. Only a payment of a positive amount counts as the first payment; an order paid in full by a discount does not. Registration of the referred account alone does not earn bonus credits. Bonus credits are governed by article 5. If the programme is abused, for example through self-referral or fictitious accounts, the operator may withdraw the reward and exclude the account from the programme.

8. Inputs, outputs and rights

  1. By uploading an input you confirm that you hold the necessary rights to it, in particular permission from the photo's author, and that using it in the service does not infringe third-party rights or the law.
  2. People in photos: the app does not ask about this separately when you upload. By uploading photos you confirm that they show no recognisable people, or that you have those people's consent to the photos being processed in the service. You are responsible for this confirmation being true.
  3. You grant the operator a non-exclusive, royalty-free right to store, process and pass inputs to suppliers to the extent necessary to provide the service. The operator will not use inputs or outputs for promotion without your consent.
  4. You may use outputs downloaded on a paid plan for your own and commercial purposes, in particular in property advertising and on social media, including after the subscription ends. The operator claims no rights to outputs.
  5. Free plan: outputs downloaded on the Free plan carry a visible label (watermark) and may be used for non-commercial purposes only, for example to try the service. You may not use them in advertising, in services to clients or otherwise in the course of business. For commercial use, choose a paid plan and download the outputs again.
  6. You acknowledge that outputs created by automated tools may not be protected by copyright and that similar outputs may be created for other users.

9. Acceptable use

When using the service it is prohibited in particular to:

  • create misleading listings, for example by hiding a property's defects or presenting a visualisation as its actual condition,
  • upload content that breaks the law or infringes third-party rights, including photos of recognisable people without their consent,
  • create content that could harm the rights or reputation of real people,
  • circumvent plan limits, security or credit accounting, access the service automatically without the operator's consent, or reverse engineer it,
  • remove, cover or otherwise get around the watermark on Free plan outputs, or use those outputs commercially,
  • share access to an account with more people than the plan allows, or create multiple accounts to obtain free credits repeatedly,
  • resell access to the service without the operator's written consent.

You must label edited photos and videos you use in listings as visualisations if they change what the photo shows, and make sure the listing is not misleading. The app offers a visible label on outputs when you download them for this purpose.

10. Data retention

We keep inputs and outputs for the period set by the account's plan. The retention period is shown in the price list in the app, and on some plans it may be unlimited. Photos, edits and videos older than the retention period of the account's plan are deleted automatically. If the account moves to a plan with a shorter retention period, for example to the Free plan after a subscription ends, data older than the new plan allows is deleted. However, after a change to a plan with a shorter retention period, including the end of a subscription, we delete nothing for 30 days; the app shows the current length of this period. During this period you can view and download the data, even though an account whose paid plan has ended cannot start new actions (article 6). Deleted data cannot be restored. On plans without a limit we keep data while the account exists, until you delete it.

Temporary files created during processing are deleted continuously, usually within 30 days. After an account is closed we delete its data within a reasonable period, except data we must keep by law, such as accounting documents. We recommend downloading important outputs as you go.

11. Liability

The service is provided as currently available. The operator is not responsible for the commercial result a user achieves with outputs, nor for outputs' compliance with the rules of property portals and social networks.

Towards a business user, compensation for damage is limited to the amount the account paid the operator in the last 12 months. This limit does not apply to damage caused intentionally or through gross negligence, to harm to health, or where the law does not allow such a limit.

12. Consumers

  1. A consumer may withdraw from a subscription contract or a credit pack purchase without giving a reason within 14 days of the contract, unless this right has been lost under the following paragraphs.
  2. Confirmation before payment: before every payment (a new subscription, a pack purchase and an immediate move to a higher plan or to yearly billing) the app asks you to tick this confirmation: “I want the service to start right away. I acknowledge that I thereby lose the right to withdraw from the contract to the extent the service has already been provided, and I agree to the terms and conditions.” With this confirmation you explicitly request that performance starts right away after payment, that is before the withdrawal period ends, and acknowledge that you lose the right to withdraw from the contract to the extent the service has already been provided. You see the same notice on the payment page above the pay button. The payment cannot be completed without the confirmation. Automatic renewals of a subscription are covered by the confirmation given with the payment that started it.
  3. If you withdraw after performance has started, the operator refunds only the part of the price corresponding to what has not yet been provided. What has been provided is determined by the share of credits from that payment already used or reserved and, for a subscription, at least by the share of the paid period that has elapsed. Unused credits from that payment lapse on withdrawal and the subscription ends with the account moving to the Free plan.
  4. If all credits from that payment have been used, the service has been fully provided and the right of withdrawal is lost. Withdrawal does not apply to Free plan credits or bonus credits.
  5. Withdrawals and complaints can be sent by email to podpora@stagendo.cz. We refund money within 14 days of the withdrawal in the same way it was received, unless agreed otherwise.
  6. Out-of-court resolution of consumer disputes falls under the Czech Trade Inspection Authority (www.coi.cz).

13. Complaints

If an output clearly does not match the request, for example it is damaged or unreadable, you may file a complaint within 30 days of its creation at podpora@stagendo.cz. Please state the project and describe the defect. A justified complaint is settled by returning the credits for the defective output to the account or by processing the input again, within 30 days. Returned credits are valid for the period shown in the app. Complaints are not settled with money. This does not affect a consumer's statutory rights for defective performance if the defect cannot be remedied in either of these ways. An output not matching a user's subjective expectations (see article 3) and the visible label on Free plan outputs are not defects. You do not need to complain about an action whose output could not be created at all; its credits are returned automatically (article 5).

14. Personal data

The operator processes users' personal data as a controller in order to provide the service, maintain accounts, invoice and communicate, in accordance with the GDPR. To provide the service we use suppliers such as hosting, storage, image-processing and payment gateway providers. We have data processing agreements with them and use appropriate safeguards for transfers outside the EU. Card details are processed by the payment gateway; the operator has no access to them. Send questions about personal data to podpora@stagendo.cz. Details are set out in the Privacy Policy.

15. Ending use of the service

You may stop using the service at any time by cancelling the subscription (article 6), deleting your data or asking us to close your account by email to podpora@stagendo.cz. If you close the account, the price paid is not refunded, not even for the remaining part of the paid period, and unused credits lapse when the account is closed.

If these terms are breached, the operator may temporarily block the account, and in case of a serious or repeated breach close it. In that case the price paid is not refunded and unused credits lapse.

If the operator closes the account without you having breached these terms, or discontinues the service entirely, it will announce this at least 30 days in advance and will not renew the subscription. It will refund the proportion of the subscription price for the paid period remaining after the end and the proportion of the price of unused credits bought in packs. Monthly plan credits, Free plan credits and bonus credits are not paid out.

16. Changes to these terms

We may change these terms, in particular when the service's features, plans or the law change. We announce a change by email or in the app at least 14 days before it takes effect. The current version is always on the Terms of service page in the app. If you disagree with the change, you may cancel the subscription and stop using the service. This does not refund the price paid.

If a change to these terms or to the service affects a consumer's access to or use of the service more than slightly, the consumer may end the contract within 30 days of the announcement or of the change taking effect, whichever is later. The operator then refunds the proportion of the subscription price for the paid period remaining after the contract ends.

17. Final provisions

Legal relations are governed by the law of the Czech Republic. Disputes are decided by the courts of the Czech Republic. If any provision is invalid, the remaining provisions stay in force. These terms are drawn up in Czech. The English and German versions are for information only and the Czech version prevails in case of conflict.

These terms are effective from 14 September 2026.
